Happy Election Tuesday to everyone in the U.S and for everyone else, Happy Tuesday/Wednesday! To kick off our November Series Open Dialogue (we deliver issues and ask for your opinion) and because it's Election Day we’d like to introduce you to Prop 60, a “sexual health issue” on the California ballot--- The Condom Law.

Proposition 60:

[ California is a leading producer of pornographic films, with most production occurring in Los Angeles' San Fernando Valley. The California Division of Occupational Safety and Health (Cal/OSHA) requires condom use during sex in pornographic films. However, Cal/OSHA generally enforces this requirement in response to complaints.[2] In November 2012, Los Angeles approved Measure B (requires performers in LA to wear condoms), which required pornography actors to wear condoms on set.] via Ballotpedia


Note: New Hampshire and California are the only states allowed to LEGALLY film pornographic movies in the U.S

Adult Film actors/actress performers are required to wear condoms while filming sexual intercourse, producers must pay for performers vaccinations and medical examinations, and producers are liable if performers do not comply with said law. Now, that sounds like an easy yes, because using condoms while filming promotes safe sex, STI awareness, and sexual health. Not quite. There are a number of groups and individuals against Prop 60---majority being performers and adult film studios.

“Aim to protect the labor rights of adult performers* Will give performers more rights against the studios who do not comply with the law (rights over their body) to protect workers from harassment or coercion. It’s also about the safety of performers health: by requiring employees to be protected from fluids that may cause infections,while reducing health risk such as STIs, and promotes safe sex in the industry and to viewers.



Why are individuals AGAINST Proposition 60:

The language used in the bill: It gives any citizen the right to sue a studio which can place performers in danger because their address and names may be revealed--leading to harassment. Also, infringes on a woman’s right to sexual freedom (Does not allow performer to have a right over their body)

This reminds me of last years Anti- Sex Trafficking bill, where the Republicans added harmful anti-abortion restrictions and other unrelated issues to the bill, so the Democrats had no choice but vote the bill down, this bill was meant to help victims of trafficking but because of the added language, the bill was shot down. Because of the language and provisions added to Prop 60, where anyone can sue a studio, the issue of privacy, and other added contingencies listed, I can understand why individuals would be against the bill. A bill that's supposed to protect the health of the worker can also put their lives at risk because anyone who is against the porn industry or a stalker can physically bring harm to a performer if they obtain their private information.

On the other hand, I understand why individuals are for it, wearing protection during sexual intercourse is meant for safety, we live in a time where ONLY 33% of millennials have been tested for an STI, many young adults are first introduced to sex via unsolicited porn ads, having pornographic film performers wearing condoms and visually promoting safe sex can make a difference. Importantly: The bill also keeps studios accountable, makes sure that the performer is fully taken care of (health wise) and is suppose to protect the rights of all workers in the industry.


It looks like both groups are after rights for all performers, they agree that sexual health is important, they aren’t trying to take away sexual freedom/expression (but it’s politics so loopholes are something you must look out for), their approaches among other things are different.

    I think this would be a good idea because it would encourage the use of condoms in non-performance based instances. The more people see it, the more likely they are to mimic the behavior aka be safer.
